Terms of Use and End User License Agreement for Feynman

1. Acceptance of this Agreement

By downloading, installing, or using Feynman, you agree to this Agreement. If you do not agree, do not use the app or services.

2. Definitions

• Application means the Feynman mobile app.
• Service means the Application and any websites, content, or features provided with it.
• Company means Feynman.
• Account means a profile you create to use parts of the Service.

3. License Grant

The Company grants you a limited, non exclusive, non transferable, revocable license to install and use the Application for personal, non commercial use on devices you own or control. The Application is licensed, not sold.

4. Restrictions

• No copying or derivative works except as allowed by law.
• No reverse engineering, decompilation, or extraction of source code where prohibited by law.
• No resale, rental, lease, sublicense, or transfer of the Application.
• No unlawful use or use that violates this Agreement or store policies.

5. Ownership

The Application and all related intellectual property are owned by the Company. You receive only the license rights set out here.

6. Accounts and Acceptable Use

• You are responsible for your Account and keeping credentials secure.
• Do not misuse the Service, attempt unauthorized access, or disrupt operations.
• Content you submit must comply with applicable laws and this Agreement.

7. Subscriptions and Purchases

The Service may offer in app subscriptions or purchases. RevenueCat and the App Store process receipts, entitlements, and fraud checks. Billing, renewals, cancellations, and refunds follow the App Store rules. Some offers may change over time.

We may collect device identifiers, purchase receipts, and entitlement data to validate access and prevent abuse.

8. Privacy

Your use of the Service is subject to our Privacy Policy. It explains what data we collect and how we use it. By using the Service you consent to that policy.

9. Third Party Services and SDKs

The Service integrates third party SDKs and services, including RevenueCat, platform app stores, analytics, and hosting. Their terms and privacy practices apply in addition to this Agreement.

10. Changes and Updates

We may update the Service and this Agreement. We will post updates on this page or within the app. Your continued use after changes means you accept the revised terms.

11. Termination

You may stop using the Service and delete the Application at any time. We may suspend or terminate access if you violate this Agreement. On termination you must stop using the Application and delete all copies.

12. Disclaimers

The Service is provided as is and as available. To the fullest extent allowed by law, the Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement.

13. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or device failure arising from use of the Service.

14. Indemnification

You agree to indemnify and hold the Company harmless from claims, losses, liabilities, and expenses arising from your misuse of the Service or violation of this Agreement.

15. App Store Terms

Your use of the Application must comply with the applicable store terms. The store provider is not responsible for support or warranty obligations unless required by law.

16. Governing Law

This Agreement is governed by the laws of the British Virgin Islands, without regard to conflict of laws principles. Courts in the British Virgin Islands will have exclusive jurisdiction, except where local law gives you non waivable rights in your home country.
